Kelly’s practices in the areas of insurance defense and bad faith litigation. She has experience defending clients against extra-contractual liability relative to personal injury, workers’ compensation, and construction defect claims. While experienced at mediation and settlement conferences, Kelly also has trial experience in Maricopa County Superior Court, the 9th Circuit Court of Appeals, and Arizona Court of Appeals. Before joining Jaburg Wilk, she worked at insurance defense firms in Phoenix, Arizona.

While in law school, she was a judicial extern for the Honorable Diane Karpinski, Eight District Court of Appeals.

Case Highlights
  • Obtained defense verdict after five-day jury trial on workers’ compensation bad faith case involving injury to knee.
  • Obtained summary judgment on Plaintiff’s punitive damages claim forcing settlement for less than 1/3 of Plaintiff’s demand in workers’ compensation bad faith case.
  • Obtained walk-away dismissal with prejudice after aggressive discovery on a workers’ compensation bad faith case involving a traumatic brain injury where Plaintiff’s alleged damages were in excess of $3 million.
  • Obtained summary judgment on breach of contract and punitive damages claims for carrier’s failure to pay accidental medical expense benefits when discovery proved carrier requested billing information and Plaintiff waited until after commencement of the breach of contract/bad faith suit to provide the relevant invoices.
  • Obtained summary judgment after proving agent of insurer owed no duty of professional care to an insured to procure adequate insurance for its business operations. (affirmed 9th Circuit)
  • Defense verdict affirmed by Arizona Court of Appeals involving construction site fatality.
  • Summary judgment affirmed on appeal involving lack of evidentiary support against grader in construction defect case.
  • Obtained summary judgment on $5 million Morris Agreement involving permissive use of a company vehicle where employee was off work and intoxicated.
  • Summary judgment affirmed by Arizona Court of Appeals on a legal malpractice case involving out of state judgment where client failed to follow counsel’s recommendation to hire out-of-state counsel to advise on issues involving foreign judgement.
