Creditors’ Rights and Bankruptcy Litigation

Our creditors’ rights attorneys assist creditors in collecting monies that they are owed by using legal remedies, including representation in bankruptcy courts. The Bankruptcy Code is complex, and in many cases, it may be subject to the interpretation of the judge hearing the case. We represent banks, construction companies, material suppliers, secured and unsecured creditors and private companies. When representing these clients, our bankruptcy attorneys counsel on issues including liability, collectability, dischargeability, preferential payments secured/unsecured transactions, and fraudulent transfers. We have represented creditor committees, lenders, secured and unsecured creditors.

In addition to our lending clients, our bankruptcy attorneys represent receivers and trustees who are appointed to deal with suspected financial fraud cases. We have worked with both federal and state governmental agencies to secure and freeze company assets and assist in maximizing recovery of funds for defrauded investors and creditors. Frequently, these cases are litigated through the bankruptcy courts.

Attorneys in this group, and our construction law group represent general contractors and subcontractors protecting their financial interests through the use of preliminary notices, lien claims, bond claims, license bond complaints, Arizona “no pay/prompt pay” provisions and lien foreclosure actions.
