Office Action Responses: Office actions resulting from other existing marks which were disclosed to client by counsel in the trademark search opinion letter are billed at our then-current hourly rate. This charge also applies to Office Actions that client was previously informed might occur.
Opposition Actions: During the trademark application process, the trademark will be published in the Official Gazette. Third parties then have the opportunity to oppose the registration of the trademark during a 30-day window. Opposition actions are rare, but do occur. Our time for oppositions is billed at our then-current hourly rate plus actual costs. The client will have the opportunity to withdraw the application for registration to avoid the fees and costs of the Opposition action.
Post-Registration Trademark Maintenance: Once a trademark is registered, there are fees associated with maintaining the registration, beginning six years after the registration date, then ten years after the registration date, and then periodically every ten years afterwards. Optional greater registration protections exist after five years of continuous use.
