Bad Faith

Arizona allows bad faith liability for failure to advise of pertinent policy provisions, allows an insured to stipulate to an unreasonable judgment if an insurer incorrectly fails to defend, and even allows bad faith liability if an insurer did not breach the insurance contract. Jaburg Wilk prides itself on identifying bad faith and punitive damages cases that should resolve and extracting insurers from such cases as soon as possible. Of course, if early resolution is not possible, then Jaburg Wilk also has substantial experience in litigating bad faith cases. Our experience includes mediations, arbitrations, settlement conferences and – when needed – trial.
